Survivors of Violence and Family Members of Victims Right to Leave and Accommodations

All employees have the right to take time off work for:

  • Jury duty or appearing in court with a subpoena.

  • Seeking protection (like a restraining order) if you're a victim of violence.

  • If you're a victim or family of a victim and your employer has 25+ workers:

    • Safety planning or staying safe from future violence.

    • Attending legal proceedings.

    • Getting/providing child or adult care to stay safe.

    • Caring for a recovering family member.

    • Getting legal, medical, mental health, shelter, or housing services.

    • Up to 12 weeks leave if you're a victim/family of a deceased victim.

    • Family members of living victims: up to 10 days (5 for relocation).

  • You may use paid leave or sick time.

  • Advance notice is required unless not possible. Documentation must follow within a reasonable time.

YOUR RIGHT TO CONFIDENTIALITY
Your employer must keep your leave/accommodation information confidential unless disclosure is legally required or needed for your safety.

YOUR RIGHT TO REASONABLE ACCOMMODATION
If you're a victim or family of one, you may request workplace accommodations for safety. Employers may ask for certification supporting the request.

YOUR RIGHT TO BE FREE FROM RETALIATION
You cannot be treated unfairly, disciplined, or fired for:

  • Being a survivor or related to a survivor.

  • Requesting time off or safety accommodations.

YOU MAY HAVE OTHER RIGHTS

  • Wage replacement: May be eligible for SDI or PFL if you can’t work due to your or a family member’s serious health condition.

  • Family and Medical Leave: May take time off for serious health needs or new children. Learn more: bit.ly/CRD-leave
