USERRA protects the job rights of individuals who leave their civilian jobs for military service (voluntarily or involuntarily) or National Disaster Medical System service.
Reemployment Rights
You have the right to be reemployed in your civilian job if:
You notify your employer before leaving
Your service does not exceed five cumulative years
You return or apply for reemployment promptly
You are not separated with a disqualifying discharge
You must be restored to your previous job or a comparable position.
Protection From Discrimination & Retaliation
Employers may not deny employment, reemployment, promotions, or benefits based on:
Past/present uniformed service
Applying or being obligated for service
They also may not retaliate against anyone assisting with USERRA enforcement.
Health Insurance Protection
You may elect to continue your employer-based health coverage for up to 24 months
Upon return, you are entitled to reinstatement in your health plan without waiting periods (unless service-connected)
